The Regular Meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at 5:00 p.m. on May 28, 2025, in the Council Chambers at the Municipal Administration Centre.

Councillor Cavanagh will open the meeting with the Land Acknowledgment Statement.

The U13 Kincardine Legion Branch 183 B team won the Ontario Minor Hockey Association championship held in Halton Hills April 4-5, 2025.

Eric Tiislere and Dave Ceksters from The Society of United Professionals, will be presenting on the Canada United Campaign.

Jonathan Farrell from Kincardine PRIDE, will be presenting on PRIDE Community Impact.

Council directed staff to investigate the implementation of a Municipal Accommodation Tax (MAT) and Short-Term Rental Accommodation licensing (STRA) in the Municipality of Kincardine. The process to explore both the MAT and STRA licensing was described in report (Strategic Initiatives – 2025-03) which included actions such as producing a financial forecast, and consulting with various groups to understand the impacts, benefits and challenges of potential implementation.

The purpose of this report is to provide Council with an update on the information collected to date to assist Council’s future decision-making.

Based on the new information presented in this report staff are seeking direction from Council on whether they would like staff to continue to explore the implementation of the Municipal Accommodation Tax (MAT) and/or the Short-Term Rental Accommodation (STRA) licensing process and proposed next steps as described in this report.

    That staff be directed to continue the exploration of the Municipal Accommodation Tax (MAT) and Short-Term Rental Accommodation Tax (STRA) licensing as outlined in the next steps identified in Strategic Initiatives -2025-10.

Lakefield Estates Phase II received final acceptance of the subdivision on November 5, 2020. The outstanding requirements for the subdivision were completed and final securities released in the Spring of 2025. Lakefield Drive and Mahood-Johnston Drive were dedicated to the Municipality as Public Highway upon the registration of Plan 3M-226. However, there are eight reserve blocks along Mahood-Johnston Drive that have not been dedicated as part of the Public Highway system. It is required that the Municipality pass a Road Assumption Bylaw to assume the Blocks along Mahood-Johnston Drive as an open and maintained roadway. Once passed, the blocks will form part of the Municipal Public Highway system. Staff have brought forward a Road Assumption by-law for consideration.

    That the Council of the Municipality of Kincardine pass a Road Assumption By-law for Blocks 45, 47, 48, 49, 51, 53, 54, 55 on Plan 3M-226 along Mahood-Johnston Drive; and

    Further that the Mayor and Clerk be authorized to execute any documents on behalf of the Municipality.

There is an existing framed cottage and concrete pad located at 4 Kuehner Drive that encroaches onto the shore road allowance by approximately 6.5m. The owners have an expiring Encroachment Agreement for the cottage and concrete pad, which was entered into in 2020. The Municipal Encroachment Policy requires encroachments that meet the definition of “major” to be brought forward to Council for consideration to enter into an Encroachment Agreement.

    That the Council of the Municipality of Kincardine direct staff to proceed with preparing the Encroachment Agreement for 4 Kuehner Street and that the Agreement be considered at a future meeting of Council.

There is an existing cottage that encroaches onto the road allowance known as Lake Street by approximately 2.5m and an existing septic system located entirely on the road allowance. The owners have obtained a building permit to install a new septic system on their property and will be removing the existing system from the road allowance. The Municipal Encroachment Policy requires encroachments that meet the definition of major to be brought forward to Council for consideration to enter into an encroachment agreement.

    That the Council of the Municipality of Kincardine direct staff to proceed with preparing the Encroachment Agreement for 95C John Street for the existing cottage and that the agreement be considered at a future meeting of Council.

The owner of the above noted property has applied to obtain exemption from the provision of Part Lot Control, as laid out in the Planning Act to create five (5) new lots. The result would be a townhome complex with each unit contained to their own lot on the subject lands and with easements for servicing, maintenance and drainage.

    That Council pass a by-law to remove certain lands known as Lot 6, reference plan 3M-220 from Part Lot Control and authorize the Mayor and CAO to execute all required documentation on behalf of the Municipality.

Council approved $70,000 in the 2025 Budget as part of the Departmental Business Plan to upgrade one park in the Birchwood/Parkwood neighbourhoods. Council requested staff conduct community engagement. Based on neighbourhood feedback, staff are recommending two smaller designs be installed at both Kin-Huron Park and Lake Huron Highlands, which does require additional funds to complete both projects and ensure compliance.

    The Council direct staff to install playground equipment at both Kin-Huron Park and Lake Huron Highlands Park; and

    That Council approve an additional $30,000 to the project budget, to be funded by the Lifecycle Reserve Fund, to ensure that both playgrounds meet the applicable accessibility requirements.

By-law to authorize the Delegation of Authority Policy By-law, presented at the April 23, 2025 Council Meeting by Staff Report #CAO General-2025-08.

    That the “Delegation of Powers and Duties Policy By-law” be deemed to be read a first, second and third time, finally passed and numbered as By-law No. 2025 - 070.

By-law to authorize a 10 year Lease Agreement with McKechnie Pharmacy LTD. for the purposes of leased space at the Hawthorne Community Medical Centre for the purposes of providing a pharmacy business.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

    2) A position, plan, procedure, criteria, or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the Municipality (Physician Recruitment and Retention Update Considerations); 

    3) A position, plan, procedure, criteria, or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the Municipality (Kincardine Family Health Organization Lease);

    4) A position, plan, procedure, criteria, or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the Municipality (Kincardine Agricultural Society Agreement);

    5)  A position, plan, procedure, criteria, or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the Municipality (W.E. Thompson Lease Agreement); and

    Further, that Council return to Regular open meeting upon completion.
