The Regular Meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at 5:00 p.m. on October 23, 2024, in the Council Chambers at the Municipal Administration Centre.

Deputy Mayor Clarke will open the meeting with the Land Acknowledgment Statement.

The Kincardine Cardinals 13U Ontario Baseball Association team is being recognized for winning the 2024 OBA “B” Provincial Championship.

James Scongack, Chief Operating Officer will provide an update on Bruce Power.

Pl.ural Design Inc. has developed a concept design for Victoria Park based on public engagement and staff input for the purposes of improved accessibility and performance pavilion.

    That Council approve the design concept for Victoria Park prepared by Pl.ural Design Inc. and Council direct staff for inclusion in the 2026 Capital Budget.

MHBC Planning, Urban Design Landscape Architecture Consulting firm (MHBC) are attending the meeting to present the Draft Comprehensive Zoning By-law to Council.

The scope of the presentation will detail highlights and the over 10,000 proposed changes / amendments that will demonstrate further alignment of the Municipality's long term goals and objectives, along with Provincial direction towards housing, infilling and diversified land uses.

    That Council receive the draft Comprehensive Zoning By-law as information and that a Public Open House be held on October 29th 2024, and further that a Public Meeting be held November 13, 2024, in accordance with 34(12)(a)(ii) of the Planning Act RSO 1990

In early 2024, a group of community housing stakeholders including representatives from Bruce County Housing, Women’s House, Community Living, Russell Meadows (existing not-for-profit housing provider), and municipal staff began meeting monthly to collaborate and advance discussions to expand affordable and supportive housing options in the Municipality.

Flourish, a consulting firm affiliated with Indwell that has extensive experience developing affordable and supportive housing across Ontario, was hired to develop an initial development concept plan exploring the potential of new affordable or supportive housing on both municipal and privately owned property. The Flourish report includes a review of several municipal properties and includes initial development concepts and preliminary financial pro forma for 705 Princes Street and a private property in Kincardine, as well as information on potential capital funding sources.

    That Council receive the report from Flourish outlining potential development concepts on municipal and private lands to expand affordable and supportive housing options for information purposes.

Council requested information related to several municipally owned properties that could be considered for use in achieving goals related to supporting increased housing options in the community. This report can be read in conjunction with the Flourish Report to help in the development of next steps. Disposing of municipal lands for housing development can provide benefits, particularly as communities face increasing housing demands. Staff recommend that Council consider one project to ensure the required work can be undertaken.

Staff are seeking approval to apply for funding through the Community Sport and Recreation Infrastructure Fund to assist in making necessary repairs to the Tiverton Sports Centre’s arena and refrigeration plant.

    That Council approve a submission to the Community Sport and Recreation Infrastructure Fund as outlined herein, including the selection of the Tiverton Sports Centre ice rink improvements project.

An application can be made for the cancellation, reduction, or refund of taxes under Section 357 or Section 358 of the Municipal Act for several reasons including but not limited to, a structure being razed by fire or demolished, or a change in classification.  MPAC can update assessment due to the change for future assessment years, however, this application allows for an adjustment to assessment from the date of the change event, with the corresponding taxes to be adjusted accordingly. 


This process is application based.  The documentation is internally reviewed and verified by staff, and then sent to MPAC for their determination of the assessment reduction.  The assessment and tax reduction are then provided to Council for final approval.


Applicants may make representations to Council if they wish to do so.

    Whereas S357 or S358 of the Municipal Act provides a process for property owners to apply for a cancellation, reduction and refund of taxes under specific circumstances including but not limited to a change in the use of a property, demolition or fire, the property being substantially unusable for a period of at least 3 months or a gross and manifest error in the preparation of the assessment roll; and

    Whereas in the opinion of staff, the 15 write-offs meet the criteria set out in the Municipal Act; and

    Whereas the total of the applications amount to $20,945.86, with the municipal share being $9,285.12; now therefore be it

    Resolved that Council approve the applications as provided.

    Whereas Policy LS.01 Community Investment Grant Policy sets out that requests for support for new projects only may be considered outside of the standard intake processes with applications to be submitted for review by the Community Investment Grant Evaluation Team who will make a recommendation to Council; and

    Whereas the Bruce County Classic Team (4-H) has submitted a 2024 Community Investment Grant application; and

    Whereas funds remain in the Community Investment Grant budget; and

    Whereas the Evaluation Team has reviewed the application and recommended a grant of $500 to be approved; now therefore be it 

    Resolved that Council approve a 2024 Community Investment Grant of $500 to the Bruce County Classic Team (4-H).

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

Recommendation: Receive and file all communications.

    That Council approve the recommendations contained in the consent agenda dated October 23, 2024 and direct staff to proceed with all necessary administrative actions.

    That Council move into closed session pursuant to Section 239 (2) of the Municipal Act, 2001, as amended for the purpose of considering:

    1) The Closed Session minutes dated October 9, 2024; 

    2) Labour relations or employee negotiations (Negotiations with Firefighters); and

    Further, that Council return to Regular open meeting upon completion.
