Introduction of interim Fire Chief Kevin McNeilly

The Municipality’s general insurance policy is currently with Frank Cowan Company and commenced on April 1, 2013 under By-Law No. 2013 - 031. The insurance policy has been renewed on an annual basis, with the current term expiring on April 1, 2020.

On December 9, 2019, municipal staff initiated a Request for Proposals (RFP) process to solicit proposals for its general insurance and risk management program. The RFP closed on February 7, 2020 and the Municipality received 3 proposal submissions. Upon evaluation of the proposals received, staff are recommending that the contract be awarded to Frank Cowan Company.

Added to the Agenda after Public Notice Provided

The purpose of this report is to request Council’s approval to authorize the Treasurer/Director of Finance to enter into an agreement with the Paddy Walker Heritage Society to include the Walker House, located at 235 Harbour Street, under the Municipality’s property insurance policy in order to reduce the annual insurance costs for the Paddy Walker Heritage Society (the “Society”). The cost of the annual insurance premium would be reimbursed to the Municipality by the Society.

The Arts, Culture and Heritage Committee has been championing the development of Public Art in the form of crosswalk art. Public Art improves awareness and encourages participation in the arts and is financially accessible to all residents.

Staff have researched best practices from other municipalities, as well as the traffic marking regulations affecting crosswalk art design.

Staff are recommending a pilot project which includes three locations and designs for 2020 and the creation of a policy which will allow for public input into future year designs.

On December 16, 2019, Council received the Phase I - Heritage Conservation District (HCD) Study prepared by Stantec Consulting Ltd.. Phase II, the HCD Plan, was approved as part of the 2020 capital budget. Due to the cost involved in the acquisition of a heritage consultant to complete the Phase II Plan, a Request for Proposals (RFP) is required to comply with the Purchasing and Procurement Policy GG.2.17.

Staff are requesting that Council exempt the purchase from the requirement for an RFP as the extension of the existing contract with Stantec Consulting Ltd. would prove more cost effective and beneficial.

The Municipality currently has a Caretaker Lease Agreement with the Kincardine Yacht Club for the care and operation of the Kincardine lighthouse and associated grounds. The agreement has been in place coming up on 10 years and the arrangement has worked well. The agreement expires at the end of May and the recommendation is to enter into a new agreement with an expiry date of March 31, 2025.

The Site Plan application is for a 12-unit residential development consisting of two 6-unit row dwellings at 755 Campbell Avenue. The drawings were circulated to various agencies for review. At the time of writing the report we were waiting for final comments from SVCA. The agreement will be finalized and signed by the applicant for the March 16th meeting. The lands have a holding provision that must be removed to allow the development. This development will provide additional multi residential units for the Municipality.

A Petition for Drainage Works by Owners has been submitted to the Municipality under Section 4 of the Drainage Act.  Pursuant to the Act, Council shall consider the petition and determine if it will or will not proceed with the drainage works.  If the decision is made to not proceed, notice must be given to the petitioners, and they may appeal this decision.  If it is decided to proceed, notice to this effect is provided to the petitioners, along with the Conservation Authority, which may request an environmental appraisal.  R.J. Burnside & Associates, who has been appointed by the Municipality to provide drainage engineering services, will hold on-site meeting with parties to examine the area.  Engineer is responsible for determining area requiring drainage and whether the petition complies with section 4 of the Act for the area requiring drainage, and if so, proceeding with preparation of report.  

Staff recommend Council proceed with the works as petitioned and consider the following as a Matter Arising from Committee of the Whole.

WHEREAS the Municipality of Kincardine has received a Petition for Drainage Works by Owners for lands at Concession 5 Lot 19, Concession 6 Lot 18 & 19, Concession 7 Lot 18 (all Township of Bruce) under Section 4 (1) of the Drainage Act, R.S.O. 1990, c.D.17;

NOW THEREFORE BE IT RESOLVED THAT Council accept the petition and indicate its intent to proceed with the drainage works and direct staff to proceed with required notices under Section 5 of the Drainage Act;

AND FURTHER THAT the Municipality of Kincardine hereby appoint R.J. Burnside & Associates Limited to prepare a report to fulfill the requirements under Section 8 of the Drainage Act for the proposed area requiring drainage.
