The Regular Meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at 5:00 p.m. on March 13, 2024, in the Council Chambers at the Municipal Administration Centre.

Councillor Blackwell will open the meeting with the Land Acknowledgment Statement.

    That the minutes of the Council meetings held on March 6, 2024 be adopted as printed.

Staff are seeking approval for the design of the Boardwalk at Station Beach. Once approved, GMBlueplan will proceed with developing tender documents for construction. The 2025 budget will include a proposal for construction of the boardwalk.

    That Council approve the conceptual design for Station Beach Boardwalk.

The Municipality received four tenders for dredging removal at the Kincardine Marina. Staff are seeking approval for the lowest bidder from Huron District Contracting Limited.

Council approved $317,505.00 for the purposes of dredging and engineering fees to complete the project. Total cost for dredging and engineering is $316,507.54 inclusive of non-recoverable HST. Work will commence once Saugeen Valley Conservation Authority approvals are received.

    That Council award the contract to dredge the Kincardine Marina to Huron District Contracting Limited in the amount of $281,773.44 inclusive of non-recoverable HST.

The Municipality of Kincardine has the opportunity to attend two physician recruitment expos: CareerMD in Rochester NY and Practice Match in New York. These career fairs booths are booked and paid for by our SOPRA (Southern Ontario Physician Recruitment Alliance) membership.

The Caspr (Canadian Society of Physician Recruitment) conference “Finding the Extraordinary in Everyday” is being held in St. John’s Newfoundland May 27-29th 2024. Conference, membership and travel costs have been included in the approved 2024 operating budget.

    That Council approve the travel required for Municipality of Kincardine staff to participate in two US physician recruitment expos and one out of province conference in 2024, as per Policy GG.1.4 and described in Report Strategic Initiatives-2024-05.

A sign permit application has been received from the owner (Craig Kirkconnell) of The Bruce restaurant located at 754 Queen St. Kincardine. The application is to replace the existing signage with backlit type lettering which will display “The Bruce.” As per Kincardine’s sign bylaw, backlit signage is not permitted within the downtown Business Improvement Area unless approved through the BIA and Council. The BIA has submitted a letter in support of the proposed lighting/ signage change which has formulated part of this report.

    That the Council of the Municipality of Kincardine grant an exemption request from section 2.17 of By-law 2003-136 for the placement of “The Bruce” backlit signage at the property located at 754 Queen St. Kincardine.

The new Community Safety and Policing Act (CSPA) will come into effect on April 1, 2024, and will repeal the existing Police Services Act. As part of this change, the existing Kincardine Police Services Board will be disbanded and replaced with a single board for the South Bruce OPP Detachment. At the meeting of February 14, 2024, Councillor Cavanagh was appointed as the Municipality of Kincardine Council representative on the Board.

The five communities involved in the new Board will also jointly appoint two community members. These members along with one Council member from each community, and two provincial appointees will make up the Board.

Council is being asked to approve the Terms of Reference for an advisory committee to aid in the selection of the two community members and to appoint Councillor Cavanagh to the Advisory Committee.

    That an ad-hoc selection committee be formed to select and appoint the required allotment of community representatives to the South Bruce OPP Detachment Board, known as the South Bruce OPP Detachment Board Community Appointee Advisory Committee; and

    That Council approve the Terms of Reference for the South Bruce OPP Detachment Board Community Appointee Advisory Committee; and

    That the same Member of Council appointed to the South Bruce OPP Detachment Board, Councillor Cavanagh, be appointed to the aforementioned Advisory Committee; and

    That Staff be directed to jointly advertise for two (2) Community Appointees to the Board, to be appointed at large throughout the detachment area; and

    Further that Council authorize the transfer of the 2024 Operating Budget as at March 31, 2024 for the Kincardine Police Services Board to the South Bruce OPP Detachment Board.

Recently, the OPP have advised that due to the legislative changes affecting the police services coming into effect April 1, 2024, there is a need to complete a new agreement prior to April 1, if council wishes to keep the enhancement of an additional provincial constable to serve as a school resource officer. The OPP are offering a new contract with three-to-six-year terms, with termination provisions requiring a one-year notice period, at no cost difference.

    That Council direct that a by-law be prepared to enter into a new agreement with the Provincial Government to support an OPP enhancement for a School Resource Officer.

    Option 2

    That Council take no action and let the existing agreement for an OPP enhancement for a School Resource Officer terminate because of changes to provincial legislation.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

    That Council move into closed session pursuant to Section 239 (2) of the Municipal Act, 2001, as amended for the purpose of considering:

    1) The Closed Session minutes dated February 14, 2024;

    2)  A position, plan, procedure, criteria or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the municipality or local board and advice that is subject to solicitor-client privilege, including communications necessary for the purpose (Bluewater Trailer Park); and

    3) A position, plan, procedure, criteria or instruction to be applied to any negotiations carried on or to be carried on by or on behalf of the Municipality or Local Board (Bruce C Impact Assessment).

    Further, that Council return to Regular open meeting upon completion.
