The Committee of the Whole (C O W) Meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at ____ p.m. on May 15, 2023 in the Council Chambers at the Municipal Administration Centre.

    That the minutes of the C O W meeting held on May 8, 2023 be adopted as printed.

Carol Blake will present a proposal to update Municipality of Kincardine Policy GG.1.13 Flag Protocol.

Claire Andrusiak will be providing an update on the Kincardine Summer Music Festival as part of Council's external partner orientation.

Karen Ribey will be presenting the Bruce Township Historical Society History Books to Council. 

The 2018 Parks Master Plan was not approved by Council and remains in draft form. During 2023 budget deliberations, Council approved $25,000 to update the existing draft Plan. Council has now requested that the scope of the Plan be expanded to include facilities and programs to provide a wholesome Plan.

    That Committee of Whole recommend that Council approve the addition of facilities and programs as part of an enhanced Parks Master Plan and that it be considered a Parks and Recreation Master Plan for a total amount of $55,000; and further

    That Council confirms its intention to fund the Parks and Recreation Master Plan using Development Charges; and further

    That the project be funded using a 50/50 share of Parks and Recreation Development Charges (RF 80) for $27,500 and the Recreation RF 72 for $27,500.

Staff is seeking approval for a five year lease agreement with the Brucedale Community Centre Association to manage and operate the Brucedale Community Centre.

    That Committee of the Whole recommend that Council pass a By-law at the June 5th Council Meeting to enter into a five year Lease Agreement with the Brucedale Community Association for operation and management of the Brucedale Community Centre

In June 2022, the Municipality of Kincardine entered into an Agreement with the Kincardine Farmers Market for the operation of the Saturday Farmers Markets at Connaught Park. This Agreement was developed to formalize the historic verbal arrangements made between the Municipality and the Association for purposes of insurance and understanding the commitment for both parties.

The previous Agreement was on the terms of a one-season agreement that commenced on June 20th and ended on October 10th. The intent to review following the 2022 season, to ensure that the content within the Agreement was still relevant. Staff are recommending that the Municipality of Kincardine enter into a lease agreement for a term of five (5) years with this established arrangement with the Association.

    That Committee of the Whole recommend that Council approve entering into a Lease Agreement with the Kincardine Farmers Market Association for the lease of certain lands located at Connaught Park.

Under Section 223.2 (1) of the Municipal Act, 2001, S.O. 2001, c. 25, municipalities are required to establish codes of conduct for members of Council and Local Boards, and those codes must address specific matters.

Council’s current Code of Conduct and Council-Staff Relations Policy were adopted in 2019. The Municipal Integrity Commissioner, Aird & Berlis LLP, has provided staff with a standard form of Code of Conduct and relating complaint protocols and forms, and Council Staff Relations Policy used by their municipal clients. These standard forms have been developed by Aird Berlis based on lessons learned and best practices implemented across the Province.

It is therefore being recommended that the attached Code of Conduct for Council and Local Boards including the complaint protocol and forms and the Council- Staff Relations Policy as prepared by Aird & Berlis LLP be adopted.

    That Committee of Whole recommend that Council place a By-law on the June 5, 2023 agenda, to adopt the updated Code of Conduct for Council Members and Local Boards, including the complaint protocols and forms; and

    Further, that Council pass a By-law on the June 5, 2023 agenda, to adopt an updated Council and Staff Relations Policy.

This report provides an update on the recent changes to the Ontario Heritage Act due to Bill 23, the More Homes Built Faster Act, 2022.

    That the Committee of Whole recommend to Council that they support the Town of Grimsby’s Resolution regarding changes to Ontario Heritage Act concerning the Municipal Heritage Register.

This report is in response to Council direction for information on an inventory of municipally owned lands that have the potential to support the creation of attainable and affordable housing. Staff have prepared GIS mapping that is currently publicly available online for Council’s review and consideration of lands that have potential for either future development for affordable and attainable housing, or lands that the Council may wish to dispose of and reserve such funds to support municipal priorities.

    That staff be directed to work with Bruce County staff to review the lands identified by Municipality of Kincardine staff as potential lands for development to support affordable and attainable housing goals and bring back a report on consideration for next steps.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

To facilitate the 2023 Scottish Festival, the event organizers, as part of the Municipality's Special Event process, have requested to be designated as an event of Municipal Significance, as well as are requesting exemptions of the Municipality's Alcohol Risk Management Policy.


That  the Council of the Municipality of Kincardine declare the Kincardine Scottish Festival and Highland Games (KSFHG) as a Municipally Significant Event that will take place July 7, 8, and 9, 2023, at Victoria Park; and further


That Council grant an exemption from GG.1.4 Alcohol Risk Management Policy (ARMP) to allow the extension of serving hours of the KSFHG licensed Pub Tent until 2:00 a.m. on Saturday, July 8, 2023, and Sunday, July 9, 2023, subject to any required municipal approvals; and further


That Council approve the KSFHG request for an exemption to the ARMP to allow for the sale of 5 tickets at one time; and further


That all pets, excluding services animals, be prohibited from Victoria Park from 3:00 p.m. on Friday, July 7, 2023, to 6:00 p.m. on Sunday, July 9, 2023, to facilitate KSFHG events; and further


That Council allow KSFHG to fence off all parking on Durham Market South and Durham Market North for vendors and the stage, except for 20 spaces along Princes for those residents and businesses displaced by the Queen Street Construction.
