The Committee of the Whole (C O W) meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at ____ p.m. on Monday March, 2, 2020 in the Council Chambers at the Municipal Administration Centre.

The financial plans for drinking water and wastewater are due to be updated for renewal of our licensing. Hemson Consulting was hired on approval of Council to propose 2 options for the updated financial plans. Option 1 is Status Quo: Maintain separate rates for Kincardine and Tiverton Water Systems. Option 2 is a Harmonized Water Structure that combines Kincardine and Tiverton into one blended water rate. Staff are recommending that Council impose Option 2 the Harmonized Water Structure. Merging the systems financially does not mean the Tiverton water system will be physically connected to the Kincardine pipeline. A report will be brought to Council at a later date to explore the options of connecting vs not connecting and the benefits or challenges operationally.

Council is being asked to award the request for quotation (RFQ) to Calgon Carbon, for a total cost of $111,936 including the non-refundable portion of HST. The total cost shown is for the equipment only. The pre-purchasing of this equipment will allow for the UV equipment to be ordered and available when a contractor is tendered for the installation later in 2020.

Council is being asked to award the request for quotation (RFQ) to Cummins Canada ULC, the lowest bidder for a total cost of $ 90,312 including the non-refundable portion of HST. The total cost shown is for 2 gen-sets: one for the Kincardine standpipe and one for the Tiverton standpipe. The pre-purchasing of this equipment will allow for the gen-sets to be ordered and available when a contractor is tendered for the installation later in 2020.

The Public Works Department has advertised the following operating tenders and is requesting that Council award them as follows:

Council is being asked to award the tender for the Queen Street Bridge Reconstruction Contract No. BR236B to the lone bidder Finnbilt General Contracting Limited for a reduced tender sum of $2,645,989.38 including the non-refundable portion of HST and further that Council grant staff authority to negotiate under Policy GG 2.17, Section 17.4 as required in order to stay within the approved finance amounts.

The tender was prepared and reviewed by BMROSS.

The Municipality’s Notice By-law No. 2008 - 126 sets out that the Municipality will provide notice of matters to be considered by Council, in the Committee of the Whole section of the meeting. This notice is to be provided via the Municipality’s website and local newspapers. During the 2020 budget deliberations, Staff recommended elimination of the advertising in the newspapers. This change was accepted by Council and incorporated into the financial estimates in the budget. As a result, the Notice By-law must be amended to reflect this change. In addition to the above change, some additional notice requirements are being recommended. A draft by-law reflecting the modifications forms part of the report.

The purpose of this report is to obtain approval for the updated Health & Safety Policy Statement which is the overarching document that will guide the health and safety program at the Municipality of Kincardine.

The Health & Safety Policy Statement will be signed by the CAO and communicated to all staff upon approval.

As previously reported this year, improvements are currently being made to the Health & Safety Manual at the Municipality of Kincardine.

The current Health & Safety Manual is one document that holds all policies, guidelines and forms and it was identified that it required some updates. The new corporate Health & Safety Manual will consist of an updated overarching Health & Safety Policy Statement and will be accompanied by a number of individual procedures that will address compliance, awareness, training & operational requirements.

The purpose of a Health & Safety Policy Statement is to ensure that the employer is in compliance the Occupational Health & Safety Act (OHSA) and its regulations and it provides guidelines for establishing and implementing procedures that will reduce workplace hazards, reduce the risk of injury and promote worker health.

Upon approval, this Health & Safety Policy Statement will be signed by the Chief Administrative Officer each year and will be posted on all Health & Safety Boards throughout the Municipality of Kincardine workplaces and will be communicated to all staff.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

In 2013 Council passed a road dedication by-law for several parcels of land. Due to the parcels being under different ownership names (Municipality, Township, Public Authority etc.) the by-law could not be registered on title. The parcel of land identified as PIN 33302-0022 aka North Line is required to be established as part of the Municipality's public highway system. And further assumed and dedicated for road purposes. Upon approval of the by-law it will be registered therefore providing adjacent properties frontage on an open and maintained municipal roadway.

 

THAT the "Road Dedication (PIN 33302-0022 - North Line) By-law" be deemed to be read a first, second, and third time, finally passed and numbered as By-law No. 2020 -

AND FURTHER THAT the Mayor and CAO have authority to sign all required documents. 

A title search was completed for PIN 33294-0418 aka Victoria Street. The roadway is currently maintained as part of the municipal roadway, therefore, a by-law establishing the road as part of the Municipality's public highway network and further assuming and dedicating the land for road purposes is required. Upon approval of the by-law it will be registered therefore providing the adjacent properties frontage on an open and maintained municipal roadway. Therefore, the No Demand for Municipal Services Agreement can be released on title from Part Lot 58 Con A Kincardine, Part 3, 3R3036, Municipality of Kincardine.

THAT the "Road Dedication (PIN 33294-0418 - Victoria Street) By-law" be deemed to be read a first, second, and third time, finally passed and numbered as By-law No. 2020 -

FURTHER THAT the No Demand for Municipal Services Agreement  be release on title from PT LT 58 CON A KINCARDINE PT 3, 3R3036; T/W R392768; KINCARDINE

AND FURTHER THAT the Mayor and CAO have authority to sign all required documents.
