Mayor Craig called to order the Regular Meeting of the Council of The Corporation of the Municipality of Kincardine at 5:00 p.m. on June 12, 2024 in the Council Chambers at the Municipal Administration Centre.

Councillor Blackwell opened the meeting with the Land Acknowledgment Statement.

General Nature of Interest: Councillor Cavanagh's wife, Dr. Angela Cavanagh, is one of the doctors participating in the event.

Plaques were presented to the Kincardine U13 Legion Branch 183 Kinucks, as they were crowned U13 Tier 1 Western Ontario Athletic Association Champions and the U13 All Ontario OMHA Champions.  

Planning Report - The Bruce County Planner Jake Bousfield-Bastedo explained the report and recommendation. Any comments received from Agencies and the Public received by the time of writing the report are in the written report.

Presentations from the Applicant - The applicants Paul and Taryanne Oudshoorn were present to answer any questions.

    That Council approve the Zoning By-law Amendment application Z-2024-011 for Paul and Tarynne Oudshoorn for 5031 Highway 9, Municipality of Kincardine.

Meg Durkin and Christina Roppel-Wahi expressed support for Council's March 2024 decision not to continue a contract to provide a School Resource Officer in schools.

    That Council approve the charging of interest as per section 26.3 for development that is eligible under sections 26.1 and 26.2 of the Development Charges Act, 1997, effective as of June 1, 2022 and at a rate of average prime plus 1%; and

    That Council repeals the former Development Charges Interest Policy GG.2.24; and

    Further that Council approve the attached new Development Charges Interest Policy to administer the charging of interest.

    That Council approve an amendment to the Traffic and Parking By-law No. 2019 - 165 to reduce the speed limit on Kincardine Ave (South Line) to 60km/h from Highway 21 easterly for 800 meters.

    That Council award the contract for project No. 9164 Bruce Ave. Reconstruction to Omega Contractors Inc. in the amount of $2,135,363.75 inclusive of the non-refundable portion of HST.

    That Council endorse both the Municipality of Kincardine Drinking Water Quality Management System Operational Plan Revision 11 May 2024 and the Quality Management System Policy Revision 3 May 4, 2022.

    That the Council of the Municipality of Kincardine pass a road dedication by-law for CEDAR LANE PL 485; KINCARDINE (PIN 33284-0143); and RED PINE ST PL 485 KINCARDINE (PIN 33284-0141);

    And further that the lands described as CEDAR LANE PL 485; KINCARDINE be known as “Institute Road Extension”;

    Whereas the lands described as RED PINE ST PL 485; KINCARDINE, is already known as “Institute Road”;

    And further that the Mayor and Clerk be authorized to execute any documents on behalf of the Municipality.

    That the Council of the Municipality of Kincardine pass a road dedication by-law for Parts 1 and 2 on 3R10512, which is part of PIN 33287-0283; and

    That the lands described as Parts 1 and 2 on 3R10512 be known as “Kaydan Drive”; and

    Further that the Mayor and Clerk be authorized to execute any documents and agreements on behalf of the Municipality.

    That Council award the contract for the supply and installation of the Connaught Park Ball Diamond lighting retrofit upgrades to 928277 Ontario Ltd. (Weber’s Electric) in the amount of $216,155.00; and

    Further, that the cost overage of $16,155.00 be funded from the Community Benefits Reserve Fund.

    Carried.

The Energy Conservation and Demand Management Plan will be considered for adoption at the June 26th, 2024 Council Meeting.

    Whereas the current Sign By-law and Sidewalk By-law requires provisions to adequately address accessibility; and

    That Council direct Staff to review the current Signage By-law and Sidewalk By-law to properly take account of the intended purpose of the AODA, the Ontario Human Rights Code and the Charter of Rights and Freedoms; now therefore be it resolved 

    That Staff bring a report addressing possible amendments to rectify any deficiencies in the current Signage By-law and Sidewalk By-law, with specific reference to Section 4.8 of the Signage By-law and Section 2.0 of the Sidewalk By-law by Q2, 2025.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

That Council authorize the request of Doug Kennedy for an exemption from the provisions of the Noise Control By-law No. 2008 - 076; for the hours of 11:00 p.m. Friday, June 21, 2024, to 1:00 a.m. on Saturday, June 22, 2024, for fundraising event “Rock with your Docs” being held at the Davidson Centre.

That Council authorize the request of the Kincardine Cubs for an exemption from the provisions of the Noise Control By-law No. 2008-076; for the hours of 11:00pm Saturday, June 22, 2024, to 1:00am on Sunday, June 23, 2024, for an annual fundraising event being held at Connaught Park.

Councillor Cavanagh did not comment or vote on the motion being considered.

    That Council move into closed meeting for the purpose of educating or training members (Applying Cultural Competency into Everyday Practices & Decisions) pursuant to Section 239 (3.1) of the Municipal Act, 2001, as amended; and

    Further that Council return to regular open meeting upon completion.

Mayor Craig reported that a Closed Session was held for the purpose of education and training the members on Applying Cultural Competency into Everyday Practices & Decisions. No Member discussed or otherwise dealt with any matter in a way that materially advanced the business or decision making of Council.
