The Regular Meeting of the Council of The Corporation of the Municipality of Kincardine will be called to Order at 5:00 p.m. on December 11, 2024, in the Council Chambers at the Municipal Administration Centre.

Councillor Blackwell will open the meeting with the Land Acknowledgment Statement.

The Municipality of Kincardine recognizes that its employees are its most important resource and appreciates the hard work and effort that is demonstrated on a day-to-day basis. The Municipality of Kincardine believes that continuous active service demonstrates a commitment to the Municipality and deserves recognition.


The Municipality of Kincardine recognized employees and firefighters who reached 5, 10,15, 20 and 25 years of continuous service in 2024 and retirees.

The Municipality of Kincardine engaged Municipal Tax Equity (MTE) Consultants to assist with a study of the impact of the current property tax assessment model for electricity industry properties in relation to other properties within the community.  The detailed analysis showed that the current provincial model has led to significant and persistent reduction in the levy share from generating station properties over the last three reassessment cycles.  The Municipality is working partners to ensure that there is an understanding of the issue.  MTE staff will present its findings.

Staff from the County of Bruce have been working towards an updated Official Plan. On October 9th Council received a presentation from County Planning Staff highlighting the proposed updates. Within the updates, there is amended mapping with proposed additions and deletions throughout the Municipal boundary. Staff are in support of the recommended proposed adjustments and are requesting Council endorsement of the considered changes.

    That Council endorse the recommended proposed changes to the County Official Plan through the proposed mapping updates as contained within Report Development Services-2024-29; and

    That staff be directed to share the local Council endorsement with Bruce County for its consideration.

In 2021, O. Reg 391/21 was passed requiring producers of packaging to become responsible for managing the end of life for these materials. By 2026, the Provincial program will transition municipalities out of the business of collecting recyclable materials with responsibility turned over to the producers of products and packaging.

The regulation identifies non-eligible sources for the collection program as Institutional, Commercial, and Industrial properties; some of whom currently have been supported through the household curbside collection through the municipality.

Some communities that have transitioned to the new provincially mandated program have opted to establish a program to allow non-eligible properties to drop off recycling at a designated municipal transfer station or landfilling site, if provided for under ministry approval. Some communities have opted to discontinue collection of recyclables from ineligible sources and non-eligible properties are required to make their own arrangements for recycling. Council is being asked to consider which direction it wishes to pursue.

If Council wishes to establish a new program for non-eligible properties to be able to drop off their recyclables there are several factors to be considered, including availability of contracted services for ICI properties, and the new costs associated with establishing a program. If Council determines that it wishes to pursue a new program, staff recommend that to accommodate the existing non-eligible properties would be through becoming a producer at the Armow Waste Management site. Staff would then work to collect information to support these non-eligible sources, based on information gathered through educational webinars, while factoring local geography and sorting site and staff capabilities.

    That staff be directed to communicate the changes as a result of Ontario’s Blue Box Program transitioning to a new Extended Producer Responsibility model in accordance with the provincial Blue Box Regulation.

    Option 2 – That Council discontinue the curbside collection of recyclable materials from ineligible sources through municipal funding effective January 1, 2026; and

    That Council endorse the investigation of a new municipal program to provide the option for non-eligible properties to drop off recycling at the arrangements at the Waste Management Site in Armow; and further

    That staff will collect information to bring forward to a future Council meeting for considerations related to licensing, costing, hours of service at the waste management site, dedicated recycling times, and any other findings brought forward from data collected through surveys and information sessions to best support all non-eligible properties; and further

    That staff be directed to communicate the changes as a result of Ontario’s Blue Box Program transitioning to a new Extended Producer Responsibility model in accordance with the provincial Blue Box Regulation.

The Municipality of Kincardine receives several requests each year to install Community Safety Zones and Traffic Calming measures in neighbourhoods. Unfortunately, the Municipality is unable to accommodate all the requests within current resources, nor are all locations suitable for community safety zones and/or traffic calming. Staff are proposing that Council support a standardized approach to addressing community safety zones and traffic calming requests submitted for review.

The Use and Installation of Community Safety Zones outlines how they are selected for review and outlines the implementation process and characteristics of selected segments of roadway where they are designated.

The proposed Traffic Calming Implementation Policy details the Municipality’s:
- Process for receiving, evaluating, and responding to traffic calming requests;
- Evaluation methodology for determining if traffic calming is appropriate for a given street;
- Appendix of applicable traffic calming measures

    That Council approve the Traffic Calming Implementation Policy as presented.

The Municipality entered into a one-year agreement with Saba Umar for concession booth services at the Davidson Centre and Tiverton Sports Centre for the 2023-2024 season that is up for renewal. The current agreement provides for a 5-year renewal option.

Staff have negotiated an agreement renewal for the Davidson Centre concession only at the request of the concession operator until March 31, 2029.

    That Council pass a by-law to enter into a five (5) year renewal lease agreement between the Municipality of Kincardine and Saba Umar for the management and operation of concession services at the Davidson Centre.

The Municipality’s existing Dog Control By-law was passed in 1999 and has had few amendments since that time. Staff undertook a review of the existing By-law and have provided a new draft by-law for Council’s consideration.

This new draft modernizes the Dog Control By-law and provides greater clarity and guidance for the Council, the public and staff. The draft by-law maintains the basic principles of the existing by-law and includes all previous amendments. The by-law has been updated to include more guidance on impoundment of dogs, dangerous dogs, kennels, and enforcement.

Items listed under the Consent Agenda are considered routine and are enacted in one motion as a Matter Arising. The exception to this rule is that a Council member or the Chief Administrative Officer may request one or more items to be removed from the consent agenda for separate discussion and action.

    2) The security of the property of the Municipality or Local Board (IT Infrastructure and Security Assessment); and

    Further, that Council return to Regular open meeting upon completion.
